The article embraces reflections regarding the problem of the moment of robbery consuming. The author reflects on the relations among the theft and robbery and presents concrete cases when the robbery was qualified as theft and vice-versa. According to the definition of the “moment of robbery consuming” notion, this moment coincides with the beginning of violence that is perilous for victim’s life or health or the threatening of applying this violence. The author presents the limits of the consumed robbery offence. The author joins the opinion that it is improper to talk about the robbery attempt, especially in case of the unaggravated robbery. Restatements of some stipulations of the Penal Law of Republic of Moldova are proposed.
