Rezumat

The executive authority of Chisinau municipality is defined vaguely by the legislative acts that regulate the local public administration in the municipality. The Law of Republic of Moldova on local public administration, № 436-XVI of 28.12.2006 regulates the provision that the subjects that ensure the local autonomy in villages (communes), cities (municipalities) are the local councils, as deliberative bodies, and mayors as executive authorities. The Law of Republic of Moldova on the statute of Chisinau municipality, № 431-XIII of 19.04.1995 establishes that public administration authorities that ensure the local autonomy in the municipality are: the municipal council, as representative authority, the town-hall and the general mayor of Chisinau municipality, as executive authorities. Firstly, it has to be mentioned that the legislator mixes the notion of the representative authority that is allocated only to the municipal council, as long as the general mayor is elected by the direct universal vote, and he/she, as the municipal council, has the direct legitimacy being the executive representative authority. Secondly, as executive bodies are mentioned 2 authorities – the town-hall of municipality and the general mayor. Certainly that such a situation cannot take place, this provision is an error and has to be overruled.
