The legal-criminal analysis of the criminal offense of illegal migration is within the article. Especially, the attention is drawn to the characters of the criminal offense’ subject: the legal-generic subject, the legal-special subject, the material subject, the victim. The investigation of the problem which can form the material subject (the product) of the criminal offense provisioned by article 3621 Penal Code of Republic of Moldova (PC RM) seems to present new aspects. Also, taking into account the international commitments of the Republic of Moldova, there are several recommendations on the legal-penal treatment of the criminal offense’ victim of organizing illegal migration. |
