In the framework of this study, the penal law examination of the offence provided in the art. 2451 „The abuses occurred in the values market participant activity” of the Penal Code is carried out. Especially, it is concluded that the main juridical object of the present offence is represented by the social relations directed to the market values participant activity, as well as because of the insiders’ activity, only if connected to the values market. At the same time, it is figured out that the victim of the present offence is the investor at the values market (or the holder of the values or the values potential costumer), whose interests are harmed as a result of the abuses occurred in the values market participant activity. And not the least, the study analyses the implead baneful action alternative methods, three in all: values market participant activity with the intention of restricting the values free circulation on the market or with the intention of committing some frauds; the values of personal concern transactions accomplished by the insiders, or of concern of some third direction, an insiders customer; others values market involvers in those actions specified hereinbefore.
