The basic purpose of this article consists in the analysis of the actual penal policies of Republic of Moldova in the sphere of informational security. One of the most disputable problems is considered to be the maintenance of international security in cyberspace. Despite extensive spreading of cyber crime, i.e. crimes in the informational sphere committed through use of computer technologies means, the laws on cyber crime that are adopted in several countries all over the world have not been coordinated yet. Moreover, even a common definition for cyber crimes is absent presently. Cyber crime laws refer to offenses against the information technology infrastructure. Such conducts includes: illegal access: the access to the whole or any part of a computer system without right; illegal interception: the interception without right, made by technical means, of non-public transmissions of computer data to, from or within a computer system; data interference: the damaging, deletion, deterioration, alteration or suppression of computer data without right; system interference: the serious hindering without right of the functioning of a computer system by inputting, transmitting, damaging, deleting, deteriorating, altering or suppressing computer data; misuse of devices; forgery; fraud. According to the actual international practice child pornography and copyright infringements are not included. |
