The subjective side is one of the most important elements of the crime. The deliberate character is specific for the crime of euthanasia as for the majority of crimes against life of a person. At the same time, taking into consideration the specific character of euthanasia, we can include in its subjective side the motive and the purpose because they underline the mitigating feature of euthanasia. This article carries out a complex analysis of the subjective side characteristics and determines the influence of the offender’s intention on the legal qualification and appreciation of criminal behaviour.
