Euthanasia is one of the most discussed crimes in the theory of criminal law. Thanks to its specific and complex structure the analysis of such a concept should be made according to the elements of crime and features specified by the law. The Criminal Code of Moldova makes a reference regarding the conditions for the victims of euthanasia. The notions of incurable disease and unbearable sufferings are very ambiguous and are not described properly in the theory of criminal law. However, their content is very important for the correct qualification of the crime and establishment the categories of persons that can be considered victims in this case. |
