Стаття присвячена вивченню гарантій забезпечення права на таємницю листування, телефонних розмов, телеграфної та іншої кореспонденції в умовах надзвичайного стану в Україні. Досліджено сутність, ознаки та види таких гарантій. Проаналізовано законодавство та наукові думки з досліджуваної теми, на підставі чого автором визначено гарантії забезпечення конституційного права на таємницю листування, телефонних розмов, телеграфної та іншої кореспонденції в умовах надзвичайного стану. У статті висвітлено проблемні аспекти в забезпеченні досліджуваного права в Україні. Автором запропоновано можливі шляхи розв’язання зазначених проблем.

The article is devoted to the study of guarantees of ensuring the right to secrecy of correspondence, telephone conversations, telegraph and other correspondence in a state of emergency in Ukraine. The essence, signs and types of such guarantees are investigated. The legislation and scientific opinions on the researched topic are analyzed, on the basis of which the author determines the guarantees of ensuring the constitutional right to secrecy of correspondence, telephone conversations, telegraph and other correspondence in a state of emergency. The article highlighted the problematic aspects in ensuring the studied law in Ukraine. The author suggested possible ways to solve these problems.

Articolul este dedicat studiului garanțiilor dreptului la secretul corespondenței, convorbirilor telefonice, telegraf și alte corespondențe în stare de urgență în Ucraina. Se cercetează esența, semnele și tipurile de astfel de garanții. Se analizează legislația și opiniile științifice pe tema cercetată, în baza cărora autorul determină garanțiile asigurării dreptului constituțional la secretul corespondenței, convorbirilor telefonice, telegraf și alte corespondențe în stare de urgență. Articolul evidențiază aspectele problematice în asigurarea studiului dreptului în Ucraina. Autorul sugerează posibile modalități de rezolvare a acestor probleme.
