Insolvency is the financial situation of the debtor, characterized by his inability to meet its payment obligations. The origins of the insolvency institution lie in Roman law. In the Republic of Moldova, insolvency is governed by the Insolvency Law no. 149/2012, in force since March 13, 2013. The insolvency procedure is divided into two stages: a) receiving and examining the application; b) the actual conduct of the insolvency procedure. Thus, if in the case of the first phase everything is directed towards the verification of the existence or non-existence of the insolvency grounds, the second stage is directed towards the purpose of the whole procedure – the satisfaction of the creditors' claims. |
