Cryptocrime (or cryptocurrency crime) is a relatively new phenomenon as soon as cryptocurrency industry per se has just emerged slightly more than a decade ago. First cryptoasset – Bitcoin - was launched in 2009. This innovation due to its cler advantages over traditional money (anonimity, extremely low transacton fees, 7/24 work shedule, P2P character) has attracted not only investors, business and financial institutions but also many criminals. On the other hand law enforcement bodies are not prepared for this kind of challenge knowing very few things about this new technology. Most of the police officers and prosecutors are not familiar with the way that this technology works nor they know how to investigate and prosecut cryptocurrency related crime. The author examines the existing concepts of cryptocrime, pointing to advantages and disadvantages of each approach. As a resault of this analysis the author’s concept is given. Cryptocrime (cryptocurrency crime) is defined as a type of financial cybercrime which consists of socially dangerous and illegal acts committed in the process of creating, circulating and destroying cryptoassets, as well as using them as a means of committing of other crimes. |
