Rezumat | ||||||
The present investigation is focused on financial analysis of the features signs, regarded as material object (product) of the offenses set forth in art.236 "Manufacture or circulation of false money signs or false securities" of the Criminal Code. There are studied the conditions when the dichotomy "material object of the crime / proceeds of crime" becomes functional. There are also subject to interpretation concepts of "banknotes (including the jubilee and commemorative ones) issued by MNB or the authorized body of a foreign state or of a monetary union of foreign states" and "coins (including commemorative and jubilee ones) issued by MNB or the authorized body of a foreign state or of a monetary union of foreign states", used in art.236 CC RM. Not least, it determines the content of the concept "used to make payments" mentioned in art.236 of the Criminal Code provision. |
