Rezumat

Within the framework of the present article, for the first time in the Penal Law Science of Republic of Moldova, a close analysis of the integrant elements of crimes provided by Art.3091 of the Penal Code of Republic of Moldova is undertaken. First of all, the incrimination opportunity of the respective deeds in the Penal Law of Republic of Moldova is grounded. For all this, there are made extensive references to the relevant international documents, as well as to the national ones. After a thorough examination of the doctrinaire opinions, the generic juridical object, the main juridical object, as well as the secondary juridical object of the torture crimes and of the crimes of organizing or instigating the torture actions are fixed. There are pointed out the individual features of the victims involved in the crimes mentioned ahead. The investigation of the particularities of the objective side of the crimes provided by Art.3091 of the Penal Code of Republic of Moldova represents another reference aspect of the article. In this direction, the theoretical approaches are supported by the numerous examples from the practice of the European Court of Human Rights.
