Euthanasia represents one of the most discussed subjects in criminal law theory, due to the fact that it has a complex character, establishment of its legal status implies a lot of legal aspects. Legal precedent played an important role it this sense, it has contributed to the legalization of euthanasia in some European countries, like Netherlands and Belgium. The purpose of this article is to establish the position of court towards euthanasia, in accordance with different states’ legislations and to demonstrate the influence of legal precedent on the process of euthanasia’s decriminalization, fact that is important for legal euthanasia research.
