If initially civil liability was interpreted through individualism, universalism and moralism, then over time it developed thanks to the conditions of public life, with the imposition of new forms of responsibility, including responsibility without fault. The basis of criminal liability is a process of logical and legal analysis, which justifies and argues the initiation of civil liability in order to obtain full compensation for damage and restore the equity and social order. The reparative function of criminal civil liability becomes paramount in relation to the sanction function of the guilty behavior of the responsible person. Criminal liability for damage caused by defective products (defects) was caused by the achievements of scientific and technological progress in the consumer society in recent years, in turn the European Union states were looking for a normative act that would take into account both the interests of the producer and consumer, as well as economic and social conditions and consequences. Therefore, on July 25, 1985, the Council of the European Community adopted Directive 85/374/EEC on the approximation of laws, regulations and administrative provisions of the Member States concerning liability for defective products. The Republic of Moldova made a commitment to the European Union to bring the horizontal legislative framework for the marketing of products in accordance with Directive 85/374 / EEC and in accordance with chapter XXXIII, the Criminal liability, in section 2, articles 2040-2046 of the Civil Code of the Republic of Moldova, our country fulfilled this obligation. |
