This article presents the analysis of some legal and practical problems regarding the institution of mediation, reflected in the specialized literature of the last years in the Republic of Moldova, Romania and other countries, as well as some elements of comparative law in the matter of mediation, the way of organizing and approaching mediation in light of the provisions of the laws of some countries with an advanced democracy, part of the family of the European Union, but with different systems of law. And in the context of examining the comparative aspect of mediation, the similarities and especially its differences in the legislation of the different states are trying to be determined, thus determining its social and legal justification, as well as elaborating the corresponding recommendations in order to improve the legislation in force for a better knowledge. of mediation in the judicial environment in the Republic of Moldova. The main methods applied in the research are: analysis, synthesis, comparison, scientific investigation, etc.
