Proportionality, a concept emerged as a replica to the multisecular inability of mankind to attain the perfection of one of the noblest ideals, which is equality, had a sinuous evolution. This evolution, nevertheless, at the beginning of the third millennium limited itself to protecting the citizens against the excess power of the state. Or, to study the proportionality through the kaleidoscope of historical, philosophical, literary, political and legal realities emphasize the universal and multifacetted vocation of this principle, a vocation recommending its extension and openness to the future, to a wide and irreversible horizon to which any wise legislature must pay attention with appropriate legislation made to match this seductive and capricious concept. |
