В статье осуществлен комплексный теоретико-правовой анализ защиты права на свободу творчества в рамках права на свободу выражения мнения в практике Европейского суда по правам человека. Для повышения уровня международно-правовой защиты свободы творчества на международном уровне признано, что правовая деятельность ЕСПЧ по защите свободы выражения мнения и, наконец, свободы творчества имеет существенное влияние на правовую систему Украины. Определено, что нормы, посвященные свободе творчества детей, работников СМИ и других субъектов требуют специального правового регулирования.

The article provides a comprehensive theoretical and legal analysis of the protection of the right to freedom of creativity within the framework of the right to freedom of expression in the practice of the European Court of Human Rights. To increase the level of international legal protection of freedom of creativity at the international level, it is recognized that the legal activities of the ECHR in protecting freedom of expression and, finally, freedom of creativity have a significant impact on the legal system of Ukraine. It is determined that the norms on the freedom of creativity of children, media workers and other entities require special legal regulation

Articolul oferă o analiză teoretică și juridică cuprinzătoare a protecției dreptului la libertatea opiniei în cadrul dreptului la libertatea de exprimare în practica Curții Europene a Drepturilor Omului. Pentru a crește nivelul de protecție juridică internațională a libertății exprimării la nivel internațional, este recunoscut faptul că activitățile juridice ale CEDO în protejarea libertății de exprimare și, în sfârșit, libertatea opiniei au un impact semnificativ asupra sistemului juridic al Ucrainei. Se stabilește că normele privind libertatea de opinie a copiilor, lucrătorilor media și a altor entități necesită o reglementare legală specială.
