В данной статье представлено исследование проблемных и актуальных вопросов реализации гражданами Украины права на бесплатную передачу земельных участков в их частную собственность из земель государственной или коммунальной собственности с применением принципа «молчаливого согласия». Предусмотрены дальнейшие перспективы получения гражданами юридического документа для подтверждения права собственности на землю. В исследовании рассматриваются различия в существующих законодательных актах, которые могут стать препятствием для реализации гражданами права на бесплатную приватизацию земли на основе принципа «молчаливого согласия» со ссылкой на судебную практику, сложившуюся в таких отношениях. Предложены возможные тенденции дальнейших изменений действующего законодательства в этой сфере с целью устранения несоответствий, обнаруженных в нормативных актах.

This article presents the investigation of problematic and urgent issues of implementation by Ukrainian citizens of the right to the free transfer of land plots into their private ownership from the lands of state or communal property with the application of the principle of “tacit consent”. Further prospects of obtaining by the citizens of a legal document for the confirmation of their land ownership are provided. The study examines differences in existing legislative acts which can become an obstacle for the citizens to realize the right to free land privatization on the basis of the principle of “tacit consent”, with reference to the judicial practice that has emerged in such relations. Possible tendencies of further changes in the current legislation in this sphere are offered in order to eliminate the discrepancies found in normative acts.

Acest articol prezintă un studiu al problemelor relevante ale exercitării de către cetățenii Ucrainei a dreptului la transferul gratuit de terenuri în proprietatea lor privată din proprietatea statului sau comunală, folosind principiul „consimțământului tacit”. Există perspective suplimentare pentru cetățeni de a obține un document legal pentru a confirma dreptul de proprietate asupra terenurilor. Studiul examinează diferențele legilor existente, care pot deveni un obstacol pentru cetățeni să exercite dreptul la privatizarea liberă a terenurilor pe baza principiului „consimțământului tacit” cu referire la practica judiciară în astfel de relații. Eventualele tendințe ale modificărilor ulterioare ale legislației actuale în acest domeniu sunt propuse cu scopul de a elimina neconcordanțele constatate în actele de reglementare.
