Rezumat

Gambling has a considerable economic significance. At the same time, this activity rises serious risks to society. For these reasons, states have felt the necessity to establish rigorous and unitary regulations in this field. Starting from 6 January 2017, organizing and conducting gambling activities on the territory of the Republic of Moldova (except for the maintenance of casinos) was monopolized by the state. The administration of activities in the field of gambling that are the monopoly of the state is carried out by the state through the National Lottery of Moldova. Moreover, the gambling organization activity, which is a state monopoly, is not subject to licensing. The National Lottery of Moldova is a Joint Stock Company established by the Government of the Republic of Moldova. It is a full state-owned company. However, de lege lata, in the Republic of Moldova there is no norm of criminal law for the illegal organizing and conducting gambling on which the state monopoly was established. There is a legislative gap. This study proposes to fill this legislative vacuum.
