In the framework of this article is performed a comparative examination of the offence prevented in the art.286 PC RM, as well of the offences against human beings: manslaughter; voluntary serious or mean injury to the body integrity or to someone’s health; brutal sexual acts etc. Among other things, it is argued that it is impossible an ideal contest between the offences pointed out in let. d) par.2 art.145 and of the art.286 PC RM, not even when the actions, which disorganize the prisons work, requires as a method the intimidation of those convicts either on their way to rectification or of those whom committed attacks against prison administration. It will operate exclusively only let.d) par.2 art.145 PC RM, if the manslaughter is committed by the convict sentenced for life imprisonment, either by the convicts on their way to rectification or by those whom committed attacks against the prison administration, connection with the victim obeying to the work or social obligations.
