The protection of citizen’s violated rights constitutes a social, economic and political necessity. According to the 53rd article of the Constitution ’’The person injured in one of his rights, through an administrative act or through a failure to solve a request in the legal term, is entitled to obtain the recognition of the claimed right, the cancellation of the act and remedies for the damage.’’ This article forms the constitutional part of exercise of the right to the compensation for the patrimonial and moral damage caused by a public authority aiming at the integral elimination of the effects of the illegal act. |
