Road traffic can be defined as an activity of social importance by means of transporting people, loads or technological equipment with the use of motor vehicles and public roads in the environment, activity carried out on the basis of social relations regulated by legal norms, which appear for the purpose of its protection of road accidents. We consider the opinion that an offense can be characterized by combining two forms of guilt in its type variant. The Criminal Law of the Republic of Moldova sets out four distinct ways of guilt (direct, indirect, negligent or exaggerated confidence in itself). Thus, the subjective side of the offenses provided in art. 264 is characterized solely by imprudent guilt towards harmful consequences, which is expressed only in the form of negligence and self-exaggerated confidence, and the recognition of distinct forms of guilt towards deed or imprudence) and distinct for consequences (imprudence) we consider it incorrect.
