Rezumat

The criminal investigation body is the person, that according to the state’s authority and within the established functions, performs the criminal investigation in criminal cases and as a subject of the criminal procedure is one of the participants of the accusation party. Because of that, we can certainly affirm that the legal competence circle, as in case of the prosecutor compiles the obligation to undertake all the legal measures to investigate fully, completely and objectively all of the circumstances that prove the guilt of the suspect, accused as well as the circumstances that are aggravating or diminishing its liability. Taking into consideration the above said, we can certainly affirm that the majority of the activities connected to the normal criminal investigation activity are performed by the criminal investigation body and we can not neglect and exclude the possibility to restrict the free access to justice of the crimes victims and their possibility to redress the infringement of their rights and liberties, a situation that leads not only to a isolated impact, but can lead to the criminality growth
