Rezumat

Our criminal code under the generic name of “homicide”, criminalizing acts that affect human life, as fundamental and indispensable attribute of the human person and to which the existence and being. These criminality set of special criminal law punishes the most serious attacks against him: murder, first degree murder, murder, infanticide, killing of guilt and determination, or facilitating suicide. Defending the person and life is a constant that is common to all systems of law, life is not so protected by law as a biological phenomenon, but above all, as a social phenomenon, primary and absolute value of any company, as a condition indispensable to the very existence of human society. The law protects not only the interest of every individual to live, to preserve and prolong life, but especially the interest of society that every human life is preserved and respected by others, preservation of life of individuals is crucial for the existence of society can not only be conceived as composed of individuals alive. Right to life of all people was solemnly proclaimed with bourgeois-democratic revolution, thus giving expression to the most noble aspirations of humanity. The same ideas were expressed by the Universal Declaration of Human Rights, adopted by UN General Assembly on December 10, 1948, which in Article 3 of the Declaration states that “Everyone has the right to life, liberty and inviolability of person” and the Covenant on Civil and Political Rights provides in Article 6 point 1 that “the inherent right to life is the human person, this right shall be protected by law and nobody can be deprived of life arbitrarily.
