Rezumat

The unpredictability theory or adjustment of the contract in the event of variance of circumstances is both an element of novelty and provocation introduced in the legislation of the Republic of Moldova through art. 623 of the Civil Code. Being criticised by some doctrinarians and appreciated by others, it is certain that the institution of unpredictability was created in the conditions of economic crisis and due to economic and financial problems that could not be foreseen by the parties at the conclusion of the contract. Unpredictability institution aims to review the effects of the legal act after breaking contractual balance and adaption of legal institutions to new requirements of the society.
