This article is devoted to analysis of criminal offenses set forth in art.160 "Illegal performance of surgical sterilization" of the Criminal Code. Of particular interest are conclusions on generic legal object, special legal subject, material object and victim of these crimes. Also, worth noting reflections on the content of harmful act, place of committing the offenses specified in art.160 CC RM and the peculiarities of the subject these crimes. The investigation is supplemented with analysis of aggravating circumstances provided in lit.b) and c) par.(3) of the art.160 CC RM. Not least, are highlighted criteria for delimitation of the offenses concerned from the surrounding facts, in particular the offenses set forth in art.151 and 152 of CC RM. |
