The importance of knowing the bases of the French civil law in general and the regulations in relation to contracts in particular lies in the following: (i) such law is often appointed as the applicable law to commercial agreements with business partners from France – such relationships are subject to a constant growth and diversification; (ii) the French law has influenced to a certain extent (which is hard to be overestimated) the civil laws of a great many countries in the world – a number of national civil codes have been conceived following the French model. During the last couple of years a group of most reputable French lawyers have proceeded to the revision of the title “Obligations” of the Civil Code. In the present article we have considered both the regulations in force and the guidelines of the above-mentioned project in regards to the non-execution of the contract. |
