Rezumat

This article is about additional elements of industrial property, especially the industrial property is regarded as a social value protected by the criminal law. The main accent is put on the examination of the Romanian Law. There is a great deal of elements which are assembled in a totality of rights entering into the notion of industrial property, such as the right on invention, the useful model, the know-how, the new species of plants, pictures and industrial projects, geographical origin names, commercial brand and topographical circuits. In other words, this scientific work is dedicated to the general approach to protection of intellectual property. Some scientific methods are applied during the explanation and examination of this problem. At the same time, an attempt is made to solve some legal problems. Also there is performed a very important and interesting question – the correlation between the civil law, which regulates social relationships of intellectual property, and the criminal law, which is called to prevent and to protect social relationships and goods from different encroachments against them. There were suggested several points of view which are necessary to be taken into consideration when a case of misappropriation is examined
