In the penal legislation of Romania, the traffic of drugs is represented by the crimes stipulated in art. 2, 3 (on condition that the purpose is not that of own consume), alin. (2) and (3) art. 6 (on condition that the purpose is not that of own consume), art. 7 from the Romanian Law no. 143/2000. The traffic of drugs is also represented by the crimes stipulated by art. 16 and 17 from the Romanian Law no. 194/2011(on condition that the purpose is not that of own consume). In the Penal Code of The Republic of Moldova, the illegal circulation of drugs is represented by the crimes stipulated by art. 2171, 2174 (on condition that the purpose is not that of own consume) and 2176 Penal Code of The Republic of Moldova.A common element of all these crimes is represented by the structure of the generic objective content:1) the expressed material element in action;2) the immediate consequence;3) the causality link between the action which constitutes the material element and the immediate consequence.
