The human freedom is one of the main values in a modern world, its defence is important therefore that it is stipulated in the laws of the most of all of the democratic countries. Although the kidnapping of a minor have never had a high degree of prominence, within the changing of the social relations, the kidnapping of people got a special attention. In 2009 the legislature has seen as a need to introduce the criminalization distinct through the art. 164¹ the kidnapping of the minors by the closed relatives, distinguishing it from that specified one in the art. 164, c), line (2), when the kidnapping is committed knowingly against a minor by a person other than his closed relative. |
