In spite of the fierce discussions surrounding it, the principle of subsidiarity continues to have a prominent place in the functioning of the multi-layered governance model of the European integration process. In particular, the principle determines when the EU is competent to legislate, and contributes to decisions being taken as closely as possible to the citizen. Because of its special importance, fundamental human rights are contained in special acts such as declaration of rights, fundamental laws. Such rights are granted with a special legal form and protection. The sphere of rights and fundamental freedoms includes the rights of human being, that are essential for life, liberty and individual dignity, essential rights for free development of human personality that have passed a long period of development and improvement |
