Over time, the notion of the civil legal act's nullity has evolved. Although in our civil law the institution of the nullity of the legal act is given a separate chapter, as in Romanian civil law we can not find a clear definition of nullity, this task coming back to the doctrine, where several formulations can be found in this regard. The nullity of the civil legal act assumes certain features and performs three basic functions. The nullity of the civil legal act must be distinguished from other similar causes, such as: rescission, termination, revocation, inopposability, caducity. The general rule of invalidity is the following formula: „It is null the legal act that does not comply with the law.” By "legal regime of nullity" we understand the rules that govern both absolute nullity and relative nullity and address three aspects: those who can plead the nullity, prescribe the right to action, and cover the nullity by confirming the legal act. |
