В статье анализируется состояние законодательного регулирования местных референдумов в Украине и законопроектной работы в Верховной Раде Украины по совершенствованию правового регулирования местных референдумов. Отмечается, что отсутствие надлежащего законодательного регулирования порядка организации и проведения местных референдумов является прямым нарушением конституционного права граждан решать вопросы местного значения и ряда других муниципальных прав и свобод. Исследуется опыт регулирования института местных референдумов в зарубежных странах. Указывается на необходимость унификации норм трех избирательных законов и закона о всеукраинском референдуме и принятия Кодекса о выборах и референдумах, который бы регулировал порядок организации и проведения выборов и референдумов, в том числе и местных, в Украине.

The article analyzes the state of legislative regulation of local referendums in Ukraine and the legislative work in the Verkhovna Rada of Ukraine on improving the legal regulation of local referendums. It is noted that the lack of proper legislative regulation of the organization and conduct of local referendums is a direct violation of the constitutional right of citizens to resolve issues of local importance and a number of other municipal rights and freedoms. The experience of regulation of the institute of local referendums in foreign countries is researched. Indicates the need to unify the norms of the three election laws and the law on an all-Ukrainian referendum and the adoption of the Code of Elections and Referendums that would regulate the organization and conduct of elections and referendums, including local ones, in Ukraine.
