В работе рассмотрены общественные отношения с участием лиц, осуществляющих строительную деятельность, органов публичной администрации, что обеспечивают возможность градостроительства в целом, а также органов со специальной компетенцией, на которые законодательством Украины возложена обязанность осуществления непосредственного контроля в той или иной области правоотношений, возникающих в процессе строительства. Предложено административную ответственность в сфере градостроительной деятельности определять как самостоятельный институт административного права, распространяющий свое действие, по общему правилу, на все виды административных правоотношений. Проанализированы нормы украинского законодательства, которыми установлена административная, а также хозяйственная и уголовная ответственность за право- нарушения в сфере градостроительной деятельности. Проанализированы соответствующие правонарушения с детальным анализом их составов. Отдельное внимание посвящено субъектам контроля и надзора в сфере градостроения.

The paper presents social relations with the persons engaged in construction activities, as well as public administration authorities, providing urban development as a whole, and the special-purpose authorities, which in accordance with Laws of Ukraine are responsible for direct control over particular areas of legal relations arising in course of construction. It was offered to define the administrative responsibility in the area of urban development activities as an independent administrative law institution, which according to the general rule covers all kinds of administrative legal relations. There were analysed the norms of the Laws of Ukraine, providing for the administrative, economic and criminal liability for violations in urban development activities. The relevant violations were analysed with a detailed analysis of their elements. Special attention was paid to the control and supervision entities in the area of urban development. It is also stipulated that the responsibility in the construction area shall be borne not only by the construction entities, but also by the public administration authorities, bound by the Constitution of Ukraine to act for the limit purpose and in the manner provided by the Laws of Ukraine.
