The different scientific going is considered near understanding of maintenance of the system of mountain right, the modern tendencies of correlation of concepts of use by the bowels of the earth and mountain business, legislation about the bowels of the earth and mountain legislation are described. The conducted analysis showed that modern development of public relations in the field of the use, guard and safety of bowels of the earth, and also mountain business, as one of basic types of these relations, ground for a new look to directions of development of legal norms of this sphere and, mainly, tendencies of their integration and differentiation. According to an authorial scientific doctrine there is the article of mountain right, as symbiosis of component parts of right for the bowels of the earth and economic right, it is necessary to determine on three concepts: is «organization of mountain business»; it is realization of mountain business»; it is «stopping of mountain business». Authorial conception of legal nature of mountain legal relationships and their objective composition, on the basis of that the ecology-economics model of the system of mountain right is set forth, offers.

Рассмотрены различные научные подходы к пониманию содержания системы горного права, охарактеризованы современные тенденции соотношения понятий недропользования и горного дела, законодательства о недрах и горного законодательства. Проведенный анализ показал, что современное развитие общественных отношений в сфере пользования, охраны и безопасности недр, а также горного дела как одного из основных видов этих отношений дают основания для нового взгляда на направления развития правовых норм данной сферы и, главным образом, тенденций их интеграции и дифференциации. Согласно авторской научной доктрине, предмет горного права как симбиоз составных частей права недр и хозяйственного права следует определять по трем понятиям: - «организация горного дела»; - осуществление горного дела»; - «прекращение горного дела». Предложена авторская концепция юридической природы горных правоотношений и их объектного состава, на основании которой сформулирована экологохозяйственная модель системы горного права.
