Covid-19 pandemic changed our lives dramatically. Before the virus outburst, there had already existed a tendency for digitalization in every aspect of our day-to-day activity – we turned to the internet and our smartphones for communication, for shopping, for entertainment, news and information – but Covid-19 speeded things up and, before we could see the bigger picture, people and companies adapted or were looking to adapt. Companies shut down their activities or, if they could and had the necessary infrastructure, moved every aspect of their business online, including their workers. Then we noticed and saw the work-from-home (WFH) benefits, and made room to start research in this area. The #Stayathome movement and regulations forced people indoors and they were left with no choice but to use online services for everything, including hanging out with friends, as well as basic needs, like food, drinks and other items they were accustomed to buy on their way home after work. This rapid shift in how we had to ensure our basic needs resulted in a rapidly developing gig economy or platform economy. Online platforms consumers used for ordering food, medicine or for commuting developed quickly and were improving their services. However, some of the legislative aspects of these platforms were left unchecked and permitted some abuses to be made by these online platforms against their workers, and their consumer-clients. In this article we tackle the legislative changes from an employment and labour law perspective, with emphasis on the Proposal for a Directive of the European Parliament and of the Council on improving working conditions in platform work (2021/0414), as well as recent legislative development from the consumer protection law. |
