This article aims to present the evolution of the legal regulations on the restitution of real estate taken over by the Romanian state in close correlation with the issue of property rights for foreign citizens.As text arguments, the whole issue was analyzed in the light of Article 44 of the Romanian Constitution, the practice of the Constitutional Court of Romania, the legislative succession of amendments made to Law No. 18 of 1991 on the land fund until the promulgation of Law No. 165 of 2013 and the pilot judgment given by the European Court of Human Rights on 12 October 2010 in the case of Maria Atanasiu et al. v. Romania. |

Ca și argumente de text întrega problemă a fost analizată prin prisma art.44 din Constituția României, a practicii Curții Constituționale a României, succesiunea legislativă a modificărilor suferite de Legea nr. 18 din 1991 privind fondul funciar până la promulgarea Legii nr. 165 din 2013 cât și a Horărârii pilot dată de Curtea europeană a Drepturilor Omului din 12 octombrie 2010 în Cauza Maria Atanasiu şialţii împotriva României.</p></description> </descriptions> <formats> <format>application/pdf</format> </formats> </resource>
