| Rezumat | ||||||
The present article is dedicated to the analyses of circumstances, that exclude the state of relapse. Their signification is unchallenged, from this reason they were expressly foreseen in the paragraph 5 of the article 34 of the Criminal Code of Republic of Moldova. To the respective circumstances are referred: committing of infraction under full legal age, committing of infraction because of imprudence, , committing of actions, that do not constitute infractions in conformity with the National Criminal Code, cases of extinguished or rehabilitated infractions. |
