Th is article provides an answer to the question: can the insolvency administrator be considered as a person invested by the state to perform activities of public interest within the meaning of para. (2) art. 123 of the Criminal Code of the Republic of Moldova? For this purpose, cases from the judicial practice are examined, in which the insolvency administrator was recognized as the subject of the crime of abuse of offi cial positions, provided in art. 335 of the Criminal Code of the Republic of Moldova. It is argued why the qualifi cation in one of these cases is incorrect. It is come to the conclusion that the insolvency administrator is a public person. |
