Rezumat

This study analyzes the criminal activity as the origin of assets subject to extended confiscation, being explored in this regard both the European legal framework and the national framework. The need to disclose the reasoning behind institution of the extended confiscation, the meaning of the phrase “criminal activity”, taken into account by the legislator when adopting this safety measure, as well as the standards of proof, have as a premise the lack of applicability of the legal provisions and the lack of jurisprudence of the national courts.
