The actuality of the judicial precedent as a source of law for the national law system is obvious. There are many discussions on this matter, during which various opinions are stated that both support and reject the de-jure implementation of the judicial precedent as a source of law. Nevertheless, it is worth mentioning that the number of implementation supporters exceeds the number of those who reject it. In this article, through the viewpoint of the current theory and practice, an analysis of the judicial precedent in Republic of Moldova is proposed. In addition, the author presents and arguments his opinion concerning the stated matter, according to which, the judicial precedent is already applied in the judicial practice of Republic of Moldova and must be legislated.
