In this article there are analyzed some of the new amendments of the Penal Code of the Republic of Moldova, especially concerning the aggravating circumstance stipulated at let. b2), par. (2), art. 171 PC RM. Thereby, the victim of the rape can be a family member and the main goal of this analysis is to relieve the criteria that can make a delimitation between the rape commited by a family member and the incest stipulated at art. 201 PC RM, making, in this manner, the right qualification. |
