An insolvency plan is applicable to companies in different states, regardless of the legal form of the company, it must ensure the satisfaction of creditors' claims, as well as protect the interests of the debtor. The insolvency plan may include reorganization (restructuring) or liquidation of the company for the same purpose. In order to accept the restructuring of the debtor company in the insolvency plan, it must correspond to increases that, as a result of the restructuring, would make it possible to satisfy the creditors' claims urgently, as well as ensure that following these procedures the debtor becomes more efficient, maintains the enterprise and has an income, i.e. be profitable. |
