Статтю присвячено проблемам визначення поняття предмета злочину, передбаченого ст. 182 «Порушення недоторканності приватного життя» Кримінального кодексу України. На основі дослідження законодавчих положень і позицій учених щодо категорій «конфіденційна інформація про особу», «особиста таємниця» та «сімейна таємниця» обґрунтовано, що предметом злочину, склад якого передбачається в диспозиції ст. 182 Кримінального кодексу України, виступають відомості особистого й сімейного характеру, що містять конфіденційну інформацію про особу. Сформульовано конкретні пропозиції щодо вдосконалення й уніфікації норм Кримінального кодексу України, що передбачають кримінально-правову охорону інформаційного аспекту недоторканності приватного життя.

The article is devoted to definition of the subject of the crime provided by art. 182 of the Criminal Code of Ukraine “Violation of privacy”. Based on research of legislative provisions and the views of scientists regarding the category of “confidential information”, “privacy” and “family secret” justified the position that the subject of the crime, the composition of which is provided in the disposition of the art. 182 of the Criminal Code of Ukraine, act information, personal and family nature, containing confidential information about the person. The author has made specific proposals for the improvement and unification of norms of the Criminal Code of Ukraine providing for criminal-legal protection of the informational dimension of private life.
