In the article on the basis of analysis of practice of the European Court on human rights the institute of confiscation is investigated in the criminal law of Ukraine. Examples of decisions of the European Court are made on human rights, in that violation of the article 1 of First protocol, articles is established 6 and 7 Conventions «About the protection of human rights and fundamental freedoms». To the conclusions arguments are driven in relation to an exception from the system of punishments of confiscation of property as such, that conflicts with legal positions of the European court on human rights

У статті на основі аналізу практики Європейського суду з прав людини досліджується інститут конфіскації у кримінальному праві України. Наводяться приклади рішень Європейського суду з прав людини, в яких констатовано порушення ст. 1 Першого протоколу, ст. ст. 6 і 7 Конвенції «Про захист прав людини та основоположних свобод». У висновках наводяться аргументи стосовно виключення з системи покарань конфіскації майна як такої, що суперечить правовим позиціям Європейського суду з прав людини.
