The article describes the concept and types of the expropriation of investments. The criteria for distinguishing indirect expropriation and state regulatory measures that do not require compensation are defined. The attention is drawn to the understudy of the issue of protecting domestic investors from expropriation. Features of legal regulation for expropriation of investments in the USA as a country with a developed tradition of investor protection are examined. Some ways of improving the national and international law on the expropriation of investments are proposed.

У статті розглянуто поняття та види експропріації інвестицій. Визначаються критерії розмежування непрямої експропріації та регуляторних заходів держави, що не потребують компенсації. Наголошується на недостатній дослідженості проблеми захисту вітчизняних інвесторів від експропріації. Розглядаються особливості правового регулювання експропріації інвестицій у США як країні з розвиненою традицією захисту прав інвесторів. Пропонуються напрями удосконалення національного та міжнародно-правового регулювання експропріації інвестицій.
