Republic of Moldova is hampered in its aspirations of becoming a full-fledged member of the international community by the frozen conflict in the Transnistria region which poses multiple legal problems in addition to the political, economic and social issues it raises. The article hereto analyzes the problems in applying International Humanitarian law throughout the armed conflict that has taken place in the region, flagging issues related to qualification and violations that have occurred making specific recommendations for improving the national legislative framework for better implementation of IHL instruments Moldova has adhered to. Among them, ratification of the Statute of the International Criminal Court represents an imperative course of actions to improve prosecution of international crimes but also to deter such abhorrent crimes,
