The defense of national security is one of the situations provided by art. 54 of the Constitution of the Republic of Moldova, which allows the temporary restriction of the exercise of fundamental rights or freedoms of citizens. In the event of a threat to national security posed by organized crime, the restrictions provided by the Constitution may be applied. The facts, namely the establishment of illegal organizations or groups that endanger state security or participation in their activity, as well as cases of organized crime and / or corruption, which undermine state security, are called threats to national security and constitute a legal basis for the initiation of actions by the competent bodies which have the effect and legitimize the temporary restriction of certain human rights or freedoms. The phenomenon of organized crime, reported at the present stage, has become globalized quite rapidly, becoming one of the main threats to national security. The problem of cross-border crime has several aspects and can be analyzed from different perspectives. So we can talk about a threat to national security due to the wide spectrum of criminal acts committed by criminal organizations, such as illegal arms and drug trafficking, human trafficking and illegal migration, corruption of state dignitaries and control of public resources, as well as assigning the legal aspect to the financial means obtained criminally by rapid introduction into the legal circuit.
