The problem that is facing the criminal justice system in Romania, today, is related to overloading the courts and prosecutors, long duration of the procedures is leading to the failure of completing the dossiers. These procedural issues are somewhat deficient, which no longer correspond to current social realities and requirements, this has been the subject of several cases at the European Court of Human Rights which Romania has been condemned repeatedly. For these reasons I will present the current situation and will try to give a few solutions. It is necessary a modern thinking in order to meet the imperatives of creating a modern justice in this cases with a tailored current duration expeditious procedures, simplify them and creating a uniform and consistent jurisprudence of the European Court of Human Rights. |
