Carrying out this work I took into consideration the decisions of the High Court of Cassation and Justice in matter of the complaint against prosecutor solutions,as well as the many controversies in this regard. Especially the provision of the article 278 ind.1 Code of criminal procedure,whereby is established the judicial control only over the notsending to trial solutions solidity in respect with the researches made among precursory acts or proceedings in criminal matters. Also the last part of this work is dedicate to the legislative changes proposed by the new Code of criminal procedure project regarding the complaints against proceedings in criminal matters measures and acts,more precise the preliminary chamber procedure. |
